Introduction
These Terms of Service ("Terms") govern your access to and use of services provided by Magic Mechanical ("Magic," "we," "our," or "us"), including our website, scheduling services, plumbing and home-service work, Magic360 Home Health Reports, estimates, assessments, and related services.
By using our website, scheduling an appointment, approving an estimate, or engaging Magic Mechanical for services, you agree to these Terms.
Services
Home Services
Magic Mechanical provides residential home services including plumbing, inspections, diagnostics, repairs, maintenance, replacements, installations, and other related services.
The specific services to be performed, associated pricing, and any applicable terms will be described in an estimate, work order, invoice, or other written authorization provided before or during service.
Scheduling
Appointments may be scheduled online, by phone, or through an authorized Magic Mechanical representative.
Appointment times and arrival windows are estimates and may be affected by traffic, emergencies, job duration, technician availability, weather, or other circumstances outside our reasonable control.
We will make reasonable efforts to communicate material scheduling changes.
Estimates and Authorization
When applicable, Magic Mechanical will provide an estimate or explanation of recommended work before beginning chargeable services.
By approving an estimate or authorizing work, you authorize Magic Mechanical to perform the services described and agree to pay the applicable charges.
Additional conditions or necessary work may be discovered after service begins. We will seek authorization before performing material work beyond the approved scope whenever reasonably possible.
Magic360 Home Health Reports
Complimentary Reports
Magic Mechanical may offer complimentary Magic360 Home Health Reports to homeowners, homebuyers, real estate professionals, or other eligible customers.
Promotional availability, eligibility, included systems, and geographic availability may change at any time.
Purpose of the Report
Magic360 is intended to provide a practical assessment of the systems and conditions observed by Magic Mechanical at the time of the visit.
A Magic360 Home Health Report is not a comprehensive home inspection, engineering evaluation, environmental inspection, appraisal, certification, warranty, or guarantee of current or future system performance.
Conditions may exist that are concealed, inaccessible, intermittent, outside the scope of the assessment, or not reasonably observable at the time of service.
Recommendations
Grades, observations, recommendations, estimated remaining life, and suggested priorities contained within a Magic360 report reflect our professional assessment based on conditions observed at the time of the visit.
Recommendations are informational and do not guarantee that a system will continue operating for any specific period.
Customer Responsibilities
Property Access
You agree to provide safe and reasonable access to the areas, fixtures, equipment, utilities, and systems necessary for Magic Mechanical to perform the requested services.
You are responsible for informing us of known hazards, unusual property conditions, restricted areas, pets, access requirements, or other circumstances that could affect the work.
Accurate Information
You agree to provide accurate information about the property, known problems, previous repairs, system history, and other relevant circumstances when reasonably requested.
Authorization
By requesting service, you represent that you are the property owner or otherwise have authority to authorize the requested inspection, assessment, repair, or other work.
Pricing and Payment
Service Charges
Pricing will be communicated through estimates, work orders, invoices, service agreements, or other written documentation.
Prices may vary based on system condition, accessibility, materials, labor requirements, permit requirements, or conditions discovered during service.
Payment
Unless otherwise agreed in writing, payment is due upon completion of the applicable service.
Magic Mechanical may require deposits, progress payments, or advance payment for certain projects, materials, equipment, or special-order items.
Additional Work
If additional work is recommended after the original scope has been approved, we will provide updated pricing or authorization requirements before proceeding whenever reasonably possible.
Cancellations and Rescheduling
We understand that plans change. Customers should provide reasonable notice when cancelling or rescheduling an appointment.
Magic Mechanical reserves the right to establish cancellation, trip, dispatch, diagnostic, or missed-appointment fees for certain services. Any applicable fees will be communicated when scheduling or before they are charged.
Materials and Equipment
Magic Mechanical may use products, fixtures, parts, materials, and equipment supplied by manufacturers or other third parties.
Availability, specifications, finishes, pricing, and lead times may change without notice.
Manufacturer warranties are governed by the applicable manufacturer's terms and are separate from any workmanship warranty provided by Magic Mechanical.
Warranties
Any warranty applicable to specific services, workmanship, equipment, or materials will be described in the applicable estimate, invoice, service agreement, or warranty documentation.
Except for warranties expressly provided in writing, services are provided to the maximum extent permitted by law without additional express or implied warranties.
Warranty coverage may not apply to damage caused by misuse, neglect, alterations by others, pre-existing conditions, improper maintenance, environmental conditions, or conditions outside Magic Mechanical's control.
Existing and Concealed Conditions
Residential systems may contain hidden deterioration, corrosion, improper previous repairs, code issues, defective components, inaccessible piping, or other conditions that cannot reasonably be identified before work begins.
Magic Mechanical is not responsible for pre-existing conditions or concealed defects that were not caused by our work.
When unexpected conditions are discovered, we will explain the issue and any recommended changes to the scope of work.
Real Estate Transactions
Magic Mechanical may provide services to homeowners, buyers, sellers, real estate agents, brokers, and other parties involved in real estate transactions.
Our assessments and recommendations are limited to the services specifically performed by Magic Mechanical.
Magic Mechanical does not determine whether a customer should purchase, sell, close on, renegotiate, or otherwise proceed with a real estate transaction. Those decisions remain the responsibility of the applicable parties and their professional advisors.
